Okay my firend went on her ex-boyfriends myspace and she wrote somethings about him, and now her ex's mom is threating her with like jail and stuff like that and threating to take her to court, but the thing is she DIDNT hack his profile he gave the password and login info to her, so can they really do anything? and if they can what?

A. In the US, defamation torts like slander and libel require that someone made false statements that damaged the other person financially. Truth is a defense. There are however different standards for public figures. Generally the person claiming defamation would need to show they lost money or were somehow damaged because of the defamation. But if you call someone a child molester, drug addict or prostitute, etc. and it's not true and it has a negative effect on their job, marriage or social standing, they may still have a valid claim. How much? What libel/slander laws apply to a blog about an old workplace?
Q. I have just survived a terrible ordeal at my workplace. I am switching careers--switching to a whole new industry. I'd like to blog about the old job, but not mention the actual name of place or people, but use it caution and educate others about how to improve their own experience. A. First off, your blog can be tracked to you by your new employer and could cost you your new job. Second, libel and slander have to be false. However, if they decide to sue you over it, it will get expensive even if you are in the right. You should also realize that someone might figure out what the place is, especially if you are identifiable on your blog. Write private journals about your experience, but don't make your comments public because it will come back to bite you. It doesn't really sound like you are educating anyone, since you didn't improve the situation, you had to change careers.

A. To be slander, it must be a lie. It must either cause a loss of income or a loss of prestiege. For example, if I say "he is a red headed ugly man" that will be construed as an opinion. If I say he robbed his last employer. That would be slander unless it is the truth. The defense against slander is that it is the truth.

A. No. Slander is a civil matter, not a criminal one. Plus this isn't even slander. Slander is verbal. Libel is written. Defamation (slander or libel) can only be addressed in civil court and it's not enough that someone is talking badly about you. There is a very specific standard before you could ever hope to bring a successful law suit.

Can someone be sued for slander for putting your job in jeopardy?
Q. I've been accused of sending someone texts on a blocked number outside of work. I offered all my phone records to them to prove I didn't do it. A. If you loose your job because of this accusation then maybe you have a case for slander (you were actually harmed by what they said). Just b/c your job is "put in jeopardy", you haven't suffered any REAL measureable damages. If you have the phone records to back it up (prove your innocence) then your job should be fine.

A. It depends on whether or not the person is actually verbally or physicall abusive. If the person has had a history of fighting or emotionally abusing someone and another person calls them out on it, it is not defamation of his or her character, but truth. If the person being labeled as an abusive person is innocent and their personal life (friends, work, etc.) has been affected, it's important to take this to court and file a lawsuit. A. If you purposely tell lies to make someone look bad or loose money then you commit slander. E.g. I was cheated by a lawyer. If I stood outside his work and told everyone he is a cheat, don't do business with him, I might be accused of slander or harassment. If I put an ad in the paper saying why I believed I was cheated, it may not be considered slanderous because I am talking about my beliefs and not his actions. If I gave false reasons like I said he charged me $4000 when he charged $2000, I could get in trouble but if I said I thought it was $2000 I might not get in trouble if it was believable that I might have got the amount wrong. A. Filing with the county circuit or superior court is filing with the state. All county circuit/superior courts are state courts. To file any lawsuit you have to outline your cause of action by making sure every element of the tort is met, including damages for slander because they are not presumed. Otherwise the complaint will be dismissed. Slander suits are complicated and depend entirely on several factors. You should see an attorney if you really believe you have a case.
